FULICON Sp. z o.o. S. K. A. with its registered office in Toruń as the personal data controller according to Regulation (EU) 106/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC, the so-called The EU General Regulation (GDPR) processes personal data.

1. Personal data as defined in the GDPR is all information regarding the identification of a natural person in any form (by letter, sound, image), such as
   np.: e.g. name, surname, address, telephone number, e-mail address, social security number, tax identification number.
   Customer personal databases at FULICON Sp. z o.o. S. K. A. are stored and secured in accordance with the security policy of FULICON Sp. z o.o. S. K. A.
2. Acording to the definition of the personal database included in GDRP it is any structured set of personal data available according to specific criteria. FULICON Sp. z o.o. S. K. A. has databases of employees, customers, suppliers, and cooperating persons, to which only authorized employees have access.
3. The processing of personal data as defined in the GDPR is any operation
   performed on personal data, such as: collecting, storing, deleting, sharing,
   development.
4. FULICON Sp. z o.o. S. K. A. processes personal data for the following purposes:
   
   1.  implementation of civil law contracts concluded with clients
   2. carrying out commercial transactions
   3. execution of orders based on orders placed by customers
   4. providing maintenance services under warranty and post-warranty contracts
   5. providing technical support services for clients
   6. conducting marketing activities, in particular: bonus sales, competitions, promotions, information campaigns,
   7. sending marketing and commercial messages via e-mail, newsletters related to products offered by FULICON Sp. z o.o. S. K. A.
   8. telephone contact for marketing and commercial purposes related to products and services offered by FULICON Sp. z o.o. S. K. A.
   9. sending of commercial messages related to products and services by post
      offered by FULICON Sp. z o.o. S. K. A.
      
      
5. Collecting, processing and using the personal data by FULICON Sp. z o.o. S. K. A. is based on the following legal grounds:
   

   I. consent expressed by customers under applicable law, including the provisions of the Act of 18 July 2002 on the provision of electronic services and the Act of 16 July 2004 - Telecommunications Law - in the case of contact via e-mail and automatic calling systems and telecommunications terminal equipment (including voice telephone calls and SMS);

   II. on the legitimate interest of FULICON Sp. z o.o. S. K. A. as the Personal Data Controller, referred to in Article 6 para. 1 point f) of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of individuals concerning the processing of personal data and the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation ("GDPR ") - for posting marketing messages - for posting marketing and commercial messages.

   Lack of consent to the processing of personal data for the purposes indicated above by natural persons and natural persons conducting business activities:
   
   1. will prevent commercial transactions
   2. will prevent the performance of maintenance services
   3. will prevent from sending commercial communications to the customers on the terms set out in this information - in the case of contact via e-mail and telephone (including voice calls and SMS)
   4. may prevent from sending commercial and marketing communications to customers on the terms set out in this information.
      
      
6. To whom we can pass your personal data and to what purpose.
   
   1. Your data we can pass to:
      a) to our employees and associates, who must have access to data in order to perform our obligations or activities on your behalf.
   2. Like most of the entrepreneurs, we also use the help of other entities in our activities, which often involves the need to provide personal data. Therefore, if necessary, we transfer your personal data to the following recipients:
      
      1. entities operating our IT and ICT system;
      2. entities conducting payment activities (banks, payment institutions);
      3. entities conducting credit activities (banks);
      4. entities conducting postal, courier or transport activities - transport of parcels of goods or forwarding services;
      5. entities dealing with debt collection.
   3. In addition, it may happen that, e.g. based on a relevant law or decision of a competent authority, we will also have to transfer your personal data to other entities, whether public or private. Therefore, it is extremely difficult for us to predict who can request to provide personal data. Nevertheless, we assure you that we analyze every case of a request for personal data very carefully so as not to accidentally pass on information to an unauthorized person.
      
      
7. FULICON Sp. z o.o. S. K. A. as the Personal Data Controller undertakes to apply appropriate security measures, both technical and organizational, to protect the personal data being processed. Personal data is stored by FULICON Sp. z o.o. S. K. A. or by data processors only for the time necessary to achieve the purposes for which these data are collected, i.e. throughout the entire duration of consent and for the period required by law (in particular tax law provisions and the limitation period for claims) after its withdrawal.
   1. Regarding individual periods of personal data processing, we kindly inform you that we process personal data for the period of:
      a) the duration of the contract - concerning personal data processed for the conclusion and performance of the contract;
      b) up to 10 years - concerning personal data processed to determine, pursue or defend claims, but not longer than it results from the applicable law;
      c) 1 year – concerning personal data that was collected in connection with the submission of the offer, and at the same time there was no immediate conclusion of the contract;
      d) 5 years - concerning personal data related to the fulfillment of tax law obligations, e.g. storage of invoices, bills;
      e) until the consent is withdrawn or the purpose of processing is achieved, but not longer than for 2 years -concerning personal data processed on the basis of consent;
      f) until the objection has been successfully lodged or the purpose of processing has been achieved, but not longer than for 2 years - concerning personal data processed based on o the Administrator's legitimate interest or for marketing purposes;
      g) until they become outdated or lose their usefulness, but no longer than for 2 years - in relation to personal data processed mainly for the purposes of using cookies and administering the website;
      h) for the duration of the product warranty, but no longer than required by applicable law.
   2. We count the periods in years from the end of the year in which we started processing personal data to streamline the process of removing or destroying personal data. Counting the deadline separately for each event would involve significant organizational and technical difficulties as well as a significant financial outlay, which is why setting one date for deleting or destroying personal data allows us to manage this process more efficiently.
   3. The right to forget: Of course, in the case of the use by Mr / Ms with the right to be forgotten, such situations are dealt with individually.
      
      
8. All persons whose data is processed have rights to the protection of personal data. In accordance with applicable data protection law, a person whose data are processed are entitled to bring an action to the competent supervisory authority (ie. The President of the Office for Personal Data Protection or body of his successor). In addition, persons whose data are processed have the right to:
   a) request access to personal data; the data subject is entitled to obtain from FULICON Sp. z o.o. S. K. A. confirmation of whether personal data concerning him are being processed, and if this is the case, he is entitled to access it. FULICON Sp. z o.o. S. K. A. will provide a copy of the personal data subject to processing upon request. For any additional copies FULICON Sp. z o.o. S. K. A. may charge a reasonable fee based on administrative costs,
   b) rectification of personal data concerning them which is incorrect. Taking into account the purposes of processing, the persons whose data are processed have the right to request supplementing incomplete personal data, including by submitting an additional statement,
   c) remove the data ( "right to be forgotten"); persons whose data are processed have the right to request, if circumstances provided for by law arise, immediate deletion of their personal data, and FULICON Sp. z o.o. S. K. A. is obliged to delete such personal data without undue delay,
   d) restrictions on the processing of personal data; in this case, FULICON Sp. z o.o. S. K. A. shall indicate such data upon request, and their processing may be restricted only to specified purposes,
   e) transferring personal data; under certain conditions, persons whose processed data have the right to receive in a structured, commonly used format, machine-readable personal data processed by FULICON Sp. z o.o. S. K. A.
   f) objection; in certain circumstances, persons whose personal data are processed have the right to object to the supervisory authority at any time - for reasons related to a particular situation - against the processing of personal data, and at FULICON Sp. z o.o. S. K. A. may be obliged to stop processing such personal data.
   
   
9. We would like to kindly inform you that we do not make automated decisions, including based on profiling.
10. We would like to kindly inform you that your personal data is not transferred outside the European Economic Area.
11. FFULICON Sp. z o.o. S. K. A. does not have a Personal Data Controller Inspector.
